Terms of Service

These terms are an agreement between you and Badland LLC (“Badland”, “we”, “us”) for your use of Badland: your personal AI agent by iMessage, SMS or phone, the website at chat.badland.ai and dashboard.badland.ai, and the Badland apps for iPhone, iPad, Apple Watch and iMessage (together, the “Service”). By creating an account or using the Service, you agree to them. Our Privacy Policy explains how we handle your data.

1. Who can use Badland

You must be at least 18 years old. You are responsible for your account and for keeping your sign-in details secure, and you won’t share your account with others. Give us accurate contact information.

2. The Service

Badland gives you an AI agent that can answer questions, search the web, generate images, remember context you share with it, set reminders and send scheduled messages, create files and pages, and use services you connect to it. The website and apps also let you chat with several AI models, use voice mode, and manage your account and agent.

We may change, add or remove features. We aim to keep the Service running around the clock but don’t guarantee uninterrupted availability, and we may suspend or discontinue it with reasonable notice.

3. AI output

AI models can be wrong, incomplete or out of date, and can say they’ve done something they haven’t. Check anything important yourself, and don’t rely on Badland for medical, legal, financial or emergency decisions. Badland is not an emergency service. You are responsible for what you ask your agent to do and for actions it takes on your instructions, including messages it sends for you.

4. Acceptable use

You agree not to use the Service to:

• break the law or infringe anyone’s rights, including intellectual property and privacy;
• create or share content that sexually exploits minors, or content that is harassing, threatening, hateful or deceptive;
• impersonate a person or organization, send spam, or contact people who haven’t agreed to hear from you;
• distribute malware, attack or probe the Service, get around its safety measures, rate limits or usage limits, or reverse engineer it;
• resell the Service or use it to train competing AI models.

We may remove content and suspend or close accounts that break these terms.

5. Your content

You keep ownership of what you put into Badland and of the output generated for you, to the extent the law allows. You give us a limited license to store, process and transmit your content, including to the AI providers listed in our Privacy Policy, only to provide the Service. Content you publish with a share link or ask your agent to publish can be seen by anyone with the link. Use of a provider’s models is also subject to that provider’s usage policies.

6. Text messages

If you sign up for an agent with your phone number, you agree to receive SMS, MMS and RCS messages from your agent. Message frequency varies with your use and the briefings and reminders you set up. Message and data rates may apply. Reply STOP to stop messages at any time and HELP for help. Carriers are not liable for delayed or undelivered messages. Consent to receive messages is not a condition of any purchase.

7. Plans and payment

Some plans are paid and are sold on our website through Stripe. A paid plan renews until you cancel it. You can cancel from your account’s billing page; deleting your account also cancels any subscription immediately. Except where required by law, payments are non-refundable. The Badland iPhone app has no in-app purchases.

8. Ending the Service

You can stop at any time by deleting your account in the app under Settings › Delete account, or by emailing us. What deletion removes, and when, is described in the Privacy Policy. We may suspend or end your access if you break these terms or if we discontinue the Service.

9. Disclaimers and liability

The Service is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. To the maximum extent permitted by law, Badland LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, and our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim, or US$50 if greater. Some jurisdictions don’t allow these limits, so they may not apply to you.

10. Apple

If you use a Badland app from the App Store, these terms are between you and Badland LLC, not Apple. Apple is not responsible for the app or its content, has no obligation to provide support or maintenance for it, and is not responsible for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You also agree to Apple’s terms for the App Store.

11. Changes

We may update these terms. We’ll post the new version here and update the date above, and tell you in the app or by email about material changes. Continuing to use the Service after a change means you accept it.
